Dear Sir,
On 24 May 2004 an exporter from the UK have shipped us a 40’ FCL container of packaging films, but it happens that after arriving of this container to our port here in SYRIA we have discovered that there is a shortage in quantity of about 6500 kilos, in addition the entire quality was totally different from what we have ordered.
Anyway, the exporter has agreed that this is his fault and fax us a Credit Note covering about 80% of our total funds and has promised to compensate us with another load at soon but this never come. Therefore, before about a month we have asked him to kindly pay us for our damage in cash, and he also did agree with this. But since then and he is always trying to fabricate new excuses when it comes to ask him why the payment has delayed so long.
We have warned him that we will fill complain against his company (registered in the UK) but this change nothing. So, please let me know if you could help us and advise the legal procedures of that we can take in order to get our right from this man through any means (court, ICC, embassy, etc).
Already we have in hands the Credit Note copy issued on exporters leatherhead and sent to us by fax, plus all the documents which we have negotiated by our irrevocable L/C at sight including: invoice, B/L and packing list.
In addition, we have the customs document showing discrepancy in quantity and quality, recording of the exporter voice by phone promising to transfer the funds and other.
